Appellate Division of the High Court Affirms that a Claimant has 8 days to lodge an Adjudication Application under section 13(3)(a) of the Building Construction Industry Security for Payment Act 2004
In a milestone decision, the Appellate Division of the High Court of Singapore in H P Construction & Engineering Pte Ltd v Mega Team Engineering Pte Ltd [2024] SGHC(A) 5 has determinatively ruled on how the 7-day deadline for the filing of an adjudication application under the Building and Construction Industry Security of Payment Act ought to be calculated. Prior to this latest decision, adjudicators and various agencies had adopted different approaches in calculating the deadline, and this area of the law had been the subject of significant debate and controversy.
This latest decision hence provides much-welcomed clarity and guidance to all parties involved in adjudication claims and proceedings moving forward.
