Moses Lin is Head of Shipping and Commodities at the firm. He specialises in commercial dispute resolution as well as restructuring and insolvency, with particular experience in the shipping and commodities/trade sectors. He advises clients on risk mitigation, commercial litigation and arbitration, and has acted as counsel in the State Courts, the High Court and the Court of Appeal in Singapore. He also regularly appears as lead counsel in international arbitrations conducted under the auspices of the SIAC, SCMA, GAFTA, FOSFA, ICC, and LMAA, among others. His experience extends to contractual and tortious disputes, corporate insolvency, bankruptcy, directors’ duties, shareholder disputes, defamation, employment disputes, as well as foreign and domestic judgment/award enforcement actions.

Whilst his expertise covers a wide spectrum of industry sectors, Moses leads the firm’s shipping and commodities practice. He regularly advises on disputes involving shipbuilding, ship sale and purchase, ship management, charterparties and cargo loss and damage, as well as demurrage or despatch and cargo off-specification claims. In addition, Moses has also been involved in major restructuring and insolvency matters, several of them involving large-scale fraudulent activity. On the transactional front, he advises on ship sale and purchase agreements as well as shipbuilding contracts.

Matter Experience


Commercial Litigation & International Arbitration
  • Acting for an owner of offshore support vessels in successfully obtaining a favourable Award in an SIAC arbitration involving a refund guarantee relating to a Chinese ship building contract;
  • Lead counsel for a South Korean commodities trading firm in SIAC and ad-hoc arbitrations against the ship owner and the cargo receiver relating to issues arising out of cargo delivered to Vietnam;
  • Lead counsel for a South Korean commodities trading firm in an SIAC arbitration involving issues of repudiation of contract, and liquidated damages and limitation of liability clauses in two commodities sale and purchase contracts;
  • Acting for Charterers in a multi-party cargo mis-delivery claim in the High Court of Singapore involving discharge of cargo against letters of indemnity without presentation of original bills of lading;
  • Lead counsel for ship managers in an SIAC arbitration relating to a ship management dispute with Russian ship owners;
  • Lead counsel for Indian commodities traders in an iron ore quality dispute being adjudicated under the auspices of the SIAC;
  • Acting for commodities traders in various disputes involving agricultural commodities under GAFTA arbitration rules;
  • Acting for various clients in actions to register and enforce arbitration awards in the High Court of Singapore;
  • Lead counsel for an international airline in a claim brought against it by 14 passengers for breach of contract which was eventually resolved by mediation;
  • Acting in an action (with a reported judgment) by BP Singapore against former employees for alleged breach of contract and misuse of confidential information;
  • Advising and acting for an F&B operator in a defamation action relating to online remarks; and
  • Advising various employers regarding enforcement of non-compete obligations and issues relating to employee compensation and unfair dismissal.
Corporate Insolvency & Restructuring
  • Lead counsel for the Private Trustees in the bankruptcy of Ng Yu Zhi, the alleged mastermind behind a large-scale Ponzi scheme through the Envy group of companies which resulted in losses totalling over S$1 billion, to recover assets for creditors;
  • Lead counsel in the restructuring and insolvency of Gulf Petrochem group of companies and related matters;
  • Acting for a bank creditor in the insolvency of Agritrade Pte Ltd which involved fraudulent activity;
  • Acting for creditors in the insolvency proceedings of Hanjin Shipping and Swiber Offshore;
  • Acting for a public-listed company in resisting winding-up proceedings;
  • Acting for the judicial managers of Armada (Singapore) Pte Ltd, advising on a multitude of legal issues arising in the operation of the company as a going concern and in the adjudication of over US$900 million of claims filed against the company;
  • Acting for the liquidators of Petroprod Ltd in the ancillary liquidation of the Norwegian manufacturer of offshore drills and rigs; and
  • Acting for the liquidators of Lehman Brothers International Pte Ltd in the insolvency proceedings following the collapse of Lehman Brothers in the Global Financial Crisis.
Shipping and Commodities / Trade
  • Lead counsel for HSBC in multiple cross-border litigation and arbitration actions (including vessel arrests and interpleader proceedings to assert claims over US$230 million worth of cargo sale proceeds) in relation to the recovery of over US$600 million in debts arising from the US$3.5 billion insolvency of Hin Leong Trading and Ocean Tankers;
  • Lead counsel for Owners of the MV STX Mumbai in High Court proceedings in an application to strike out an action and set aside the arrest of a vessel with the award of damages for wrongful arrest. Judgment was reported in the Singapore Law Reports and is regularly cited as authority in similar cases;
  • Lead counsel in an action seeking an injunction and pre-action discovery against a ship owner on behalf of Swiss cargo owners;
  • Acting for various creditors in the successful arrest and release of vessels in Singapore;
  • Acting for fuel oil traders in a cross-border multi-party dispute involving the supply of off-spec bunkers; and
  • Acting for buyers as well as sellers, and as escrow agent, in ship sale and purchase agreements.
