Daryl Fong is a partner in Shook Lin & Bok’s Litigation & Dispute Resolution department, with a focus on commercial disputes, international arbitration, cross-border restructuring and insolvency, insolvency-related litigation and fraud. He also has extensive experience in the following areas: financial services and securities, shareholder disputes, directors’ duties and employment law.
Daryl regularly advises and acts for insolvency professionals, institutional and corporate creditors and multinational corporations, amongst others. He has appeared as lead counsel at all levels of the Supreme Court of Singapore and in international commercial arbitrations administered by leading arbitral institutions.
- Acting for the Liquidators of the Envy Companies (i.e., Envy Asset Management Pte Ltd, Envy Management Holdings Pte Ltd and Envy Global Trading Pte Ltd) in the Suit brought against the former directors and/or representatives of the Envy Companies to recover unauthorised/fraudulent transactions made out of investors’ funds. The Envy Companies solicited in excess of S$1.1 billion of investments from upwards of 900 investors;
- Acting for the independent panel of Aljunied-Hougang Town Council in a claim against the current members and elected members of Parliament over alleged improper payments;
- Acting for the former independent directors of Hyflux Pte Ltd (In Compulsory Liquidation) in criminal proceedings;
- Acting for the former liquidators of AnAn Group () Pte Ltd, a subsidiary of an international oil and petrochemical entity listed on the SGX. This was the first liquidation to be reversed by the Court of Appeal in Singapore;
- Acted for the Liquidators of Kyen Resources Pte Ltd, a metals trading company which was a subsidiary of company listed in China;
- Acting for judicial managers and current liquidators of Acesian Star (Singapore) Pte Ltd, a sub-contractor in the construction of Terminal 1 and 4 of the Changi Airport;
- Acted for the Export-Import Bank of China in restructuring of Pacific International Lines, which is one of the 10 largest container shipping lines in the world, with a fleet of nearly 100 vessels;
- Acted for the liquidators of a subsidiary of the Swiber Group of companies;
- Acted for the former executive directors of Datapulse Technology Limited in disciplinary proceedings commenced by the Singapore Exchange;
- Acted successfully as Lead Counsel for KPMG Singapore in a dispute against a creditor which went before the Court of Appeal;
- Acting as Lead Counsel for the lenders under a loan agreement against the borrowers in an arbitration involving allegations of fraud and undue influence;
- Acted successfully for Sunteck Realty, a Mumbai-based luxury real estate developer, in an application before the Singapore High Court related to a multi-million dollar arbitration dispute in Dubai;
- Acted successfully in a High Court action on a secured loan agreement, where the dispute centered on a proposed acquisition valued at RM50 million by an SGX-Listed company in the business of property development, waste management and recycling enterprise;
- Acted for a South Korean commodities trading firm against two Bangladeshi commodities trading firms, in an arbitration in relation to non-delivery of cargo;
- Acting for four Respondents in arbitration proceedings commenced by a Singaporean fintech company for claims respect of breach of directors duties and obligations under a shareholders agreement;
- Acting for and advising US real estate companies and their president in respect of disputes over onerous terms in a fund arrangement agreement;
- Acting for the Industrial Bank of Korea in proceedings relating to a moratorium granted by the High Court to Antanium Resources Pte Ltd pursuant to section 64 of the IRDA, as well as advising on proceedings against the Antanium Group, including but not limited to winding up and enforcement of arbitral awards; and
- Acting for and advising the Liquidators of SC Aetas Holdings Pte Ltd. The Company raised funds to build a new building in Bideford Road and subsequently ran into financial difficulties.
