Soong Jun De specialises in commercial dispute resolution, with a particular focus in shipping and commodities/trade disputes. He regularly advises on disputes involving shipbuilding, ship sale and purchase, ship management, charterparties and cargo loss and damage, as well as demurrage or despatch and cargo off-specification claims.
- Acting for The Hongkong and Shanghai Banking Corporation (HSBC) in relation to enforcement of loan facilities extended by HSBC to Hin Leong Trading, which were secured by purportedly original bills of lading;
- Acting for Malayan Banking Berhad (Maybank) in relation to enforcement of loan facilities extended by Maybank to Agritrade International Pte Ltd (Agritrade), which are secured by purportedly original bills of lading pledged by Agritrade;
- Acting for the commodities trading arm of an India-headquartered conglomerate in a multi-party dispute involving liability under letters of indemnity it used in favour of a group of companies which supplies commodities such as timber and coal, in respect of a cargo mis-delivery claim by a financing company (as the lawful holder of the original bills of lading);
- Acted on behalf of the Hong Kong branch of one of the largest banks in China in the arrest of a vessel for the enforcement of a ship mortgage;
- Acted on behalf of a BVI company in an ICC arbitration against a Chinese trading company involving a dispute over the sale and purchase of bauxite;
- Acted on behalf of Chinese Ship-Owner in the defence of a misdelivery claim brought before the Singapore High Court by a Singapore-based bank;
- Acted for a Chinese company listed on the New York Stock Exchange in its claim against an Indian company for unpaid purchase price under a supply contract for solar wafer products;
- Acted for a Singapore-based company against a Hong Kong company in a SIAC arbitration involving a multi-million dollar dispute over a sale and purchase contract for the purchase of iron pellets;
- Acting on behalf of a Chinese-based logistics company (part of a large Chinese conglomerate) in a SIAC arbitration against an Indonesian-based trading company involving a multi-million dollar dispute over the sale and purchase of nickel hydroxide;
- Acted on behalf of a large Chinese trading house in an ad-hoc Singapore arbitration to defend a claim brought by a large Korean conglomerate arising from a dispute relating to a sale and purchase agreement for oil products;
- Acted for an owner of offshore support vessels in successfully obtaining a favourable Award in an SIAC arbitration involving a refund guarantee relating to a Chinese ship building contract; and
- Acted for a South Korean commodities trading firm in an SIAC arbitration involving issues of repudiation of contract, and liquidated damages and limitation of liability clauses in two commodities sale and purchase contracts.
